House Energy and Commerce Committee Chair Cathy McMorris Rodgers (R-WA), Subcommittee on Health Chair Brett Guthrie (R-KY), and Subcommittee on Oversight and Investigations Chair Morgan Griffith (R-VA) have expanded their investigation into sexual harassment at the National Institutes of Health (NIH) to now include a review of the Department of Health and Human Services (HHS) Office of Civil Rights (OCR) compliance role.

In a letter to HHS Secretary Xavier Becerra, the Republican leaders expressed concerns about the role of OCR in investigating instances of sexual harassment at research institutions funded by the NIH. They highlighted the significant problem of sexual or gender harassment cases at NIH-funded research activities, with about a third of the allegations being substantiated. The letter emphasized the need for a resolution to ensure a safe and non-hostile research environment for all individuals involved.

The Chairs raised questions about the role of HHS OCR in handling complaints of sexual harassment and ensuring compliance with Title IX programs by institutions receiving federal financial assistance from HHS. They requested answers from HHS OCR by April 30, 2024, seeking clarity on the procedures and actions taken to address sexual harassment issues.

The investigation stems from a recommendation by the U.S. Government Accountability Office (GAO), leading to a memorandum of understanding (MOU) between HHS OCR and the NIH. The MOU aimed to enhance communication between the two components of HHS regarding sexual harassment complaints, enforcement procedures, and the prevention of federal grant money going to individuals with a history of sexual misconduct.
